Terms of Service

Draft: legal review is recommended before the commercial launch. This text describes how NXCBusiness works today, but it is not legal advice or the final version.
These terms govern the use of NXCBusiness, the cloud business management platform available on this site. By using NXCBusiness or subscribing to a plan you accept these terms together with the privacy policy and the refund policy.
1. Introduction and who provides the service
NXCBusiness (“the Platform”) is the commercial brand of the product; it is not a legal entity. The Platform is offered by [LEGAL_NAME_REQUIRED], with tax identification [TAX_ID_REQUIRED] and registered address at [LEGAL_ADDRESS_REQUIRED], [LEGAL_COUNTRY_REQUIRED] (“we”).
2. Description of the service
NXCBusiness is software as a service to manage customers and CRM, quotes, sales, internal invoicing, receivables and payments, suppliers, purchasing, inventory and, in beta, people (employees, attendance, time off, documents and job openings). Each organization has its own space with its users, roles and data.
What NXCBusiness is not today: internal invoicing is not an electronic tax document filed with a tax authority, NXCBusiness People does not run payroll, and capabilities marked as “coming soon” are not available. Beta features may change.
3. Requirements to use NXCBusiness
NXCBusiness is intended for independent professionals and organizations. You must have legal capacity to contract and, if you act on behalf of an organization, authority to bind it. During early access, organizations are activated by invitation of the NXCBusiness team.
4. Accounts and security
You are responsible for the information you enter, for who you give access to your organization and with which role, and for keeping your credentials confidential. Tell us immediately if you detect unauthorized access.
5. Plans and subscriptions
Plans, their prices, limits and capabilities are published on Pricing. A paid plan is a recurring subscription: it is purchased for a period (monthly or annual, as you choose) and renews automatically until cancelled. When a plan includes a free trial, stated on Pricing and in the checkout, the first charge is made when the trial ends, unless you cancel before.
6. Billing and payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it processes the payment, issues the receipt, handles the taxes that apply to the transaction and handles inquiries about payments and returns.
Payments are made from your account (Settings → Plan and usage). NXCBusiness does not receive or store your card details.
7. Renewal
Subscriptions renew automatically at the end of each period at the current price of your plan, unless you cancel before the renewal date. If the price changes, we will notify you reasonably in advance before it applies.
8. Plan changes
You can move to a higher or lower plan. Changing plans does not delete information: if your usage exceeds the limits of the new plan, you keep your data but cannot add more records of that type until you upgrade or reduce usage.
9. Cancellation
Cancelling a subscription stops future renewals; the service remains available until the end of the period already paid. Cancelling does not by itself result in a refund: refunds are governed by the refund policy. Cancelling does not delete your account or your data either; deleting the account is a separate request.
10. Acceptable use
You must not use NXCBusiness for illegal activities, to infringe the rights of others, to send malicious content, to try to access other organizations’ data, or to overload or circumvent the platform’s limits and controls.
11. Intellectual property
The software, brand and materials of NXCBusiness belong to us or are used under license. We grant you a limited, non-exclusive and non-transferable right to use the service while your subscription is active.
12. Customer data
The data your organization enters belongs to it. We process it to provide the service, as described in the privacy policy. Each organization is isolated from the others.
13. Third-party services
NXCBusiness runs on infrastructure providers (hosting and network) listed in the privacy policy. If you publish job openings, their public content may be read by search engines and job boards; integrations with job boards that require their own agreements are only enabled when those agreements exist.
14. Service availability
We work to keep NXCBusiness available, but during early access we do not commit to a service level (SLA). We may perform maintenance and changes to improve the service.
15. Suspension and termination
We may suspend an account for non-payment or for breach of these terms. A suspended account keeps its data and works with the capabilities of the free plan until the situation is resolved. You can terminate the service at any time by cancelling your subscription.
16. Disclaimer of warranties
Except where applicable law does not allow exclusion, the service is provided “as is” and “as available”, especially beta features.
17. Limitation of liability
To the extent permitted by applicable law, our total liability for any claim related to the service is limited to the amount paid by your organization in the twelve months before the event giving rise to it. Nothing above limits rights that the law recognizes as non-waivable.
18. Changes to these terms
We may update these terms. Each version states its number and date; relevant changes will be announced before they take effect.
19. Governing law and jurisdiction
These terms are governed by: [JURISDICTION_REQUIRED]. Mandatory consumer rights granted by the law of your country are preserved in all cases.
20. Contact
